Legal Disclaimer, Assumption of Risk & Limitation of Liability
1. General Use & Assumption of Risk
By purchasing or using Suan Earplugs ("Product"), you ("User") acknowledge and agree that the use of this Product is entirely at your own risk. You understand that earplugs are designed to be inserted into the ear canal and that such use carries inherent risks. Suan shall not be liable for any issues arising from the use, misuse, or inability to use the Product.
2. Health & Hygiene Warning
You are solely responsible for the proper use and hygiene of your Product.
- Infection: Failure to regularly clean and properly store the Product can create a breeding ground for bacteria, leading to serious ear infections or other medical conditions. Clean your earplugs regularly with mild soap and water, dry them completely, and store them in the provided case.
- Earwax Impaction: Regular use of any earplug can push earwax deeper into the ear canal, potentially causing blockages, discomfort, temporary hearing loss, or tinnitus.
- Medical Consultation: Discontinue use immediately if you experience any pain, discomfort, discharge, irritation, or hearing loss. Consult a qualified physician before resuming use. Do not use this product if you have a pre-existing ear condition, such as a perforated eardrum or ear infection, without first consulting your doctor.
3. Critical Safety Warning: Risk of Missing Alarms & Sounds
WARNING: CRITICAL SAFETY RISK
This Product is designed to reduce perceived sound. It will significantly impair your ability to hear important, critical, and emergency sounds. This includes, but is not limited to:
- Smoke alarms
- Carbon monoxide (CO2) detectors
- Baby monitors or crying infants
- Intruders or breaking glass
- Warning shouts or traffic
DO NOT use Suan Earplugs in any situation where your ability to hear such sounds is critical for your personal safety or the safety of others. The User assumes all risk for any injury, damage, or death resulting from the inability to hear sounds while using the Product.
4. Fit, Comfort & Product Integrity
Improper fit or insertion can lead to pain or damage to the ear canal or eardrum.
- Do not force the earplug deep into the ear canal. Insert it gently according to the instructions.
- Inspect your earplugs before every use for signs of wear, tear, or damage (e.g., cracks, hardening, or breakage).
- Discard immediately if the Product is damaged. A broken component could become lodged in the ear canal, requiring medical removal.
5. Performance & Limitation of Liability
Any Noise Reduction Rating (NRR) or decibel (dB) reduction figures provided are estimates based on laboratory testing. Actual noise reduction is highly dependent on individual ear anatomy, proper fit, and the specific sound environment. We do not guarantee a specific level of performance.
Suan Earplugs are not certified for, and should not be used for, hearing protection in industrial settings, at shooting ranges, or against impulse noise (e.g., explosions) unless explicitly stated.
To the fullest extent permitted by law, Suan shall not be liable for any direct, indirect, incidental, special, or consequential damages (including but not limited to personal injury, hearing loss, or property damage) arising from the use or misuse of the Product.
